Copyright Policy and DMCA Notices

Eloking Ltd. ("Eloking", "we", "us") respects the intellectual property rights of others and expects everyone who contributes to our website to do the same. This page explains how to notify us of material you believe infringes your copyright, how we handle those notices, and how to dispute a removal.

Email is strongly preferred and will always be the fastest route. Notices sent to this address are reviewed and actioned directly by us; you do not need to involve our hosting provider, registrar or any other intermediary in order to reach us.

How to submit a notice of claimed infringement

So that we can act on your notice quickly and accurately, please include all of the following:

1. Identification of the specific copyrighted work you claim has been infringed. If you are claiming multiple works, a representative list of those works. Please identify the work itself — a link to your home page or social media profile does not allow us to determine what material is at issue.
2. Identification of the material you claim is infringing, with enough detail for us to locate it. The full URL of each page, and where a page contains several items, an indication of which item on that page you are referring to.
3. Your name, postal address, telephone number and email address.
4. A statement that you have a good faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law.
5. A statement that the information in your notice is accurate, and, under penalty of perjury, that you are the copyright owner or authorised to act on the owner's behalf.
6. Your physical or electronic signature.

These are the elements set out in 17 U.S.C. § 512(c)(3). We will still review any good faith complaint that does not follow this format, but an incomplete notice — in particular one that does not identify the specific work said to be infringed — may take longer to process, because we will need to come back to you for that information before we can assess it.

What happens after we receive a notice

We aim to acknowledge every notice within two business days and to complete our review promptly. Where a complaint is well founded, we expeditiously remove or disable access to the material. We keep a record of each notice received and of the action taken.

Where material was submitted by an identifiable contributor, we will notify them that their material has been removed and provide them with a copy of the notice, so that they may submit a counter-notification if they believe the removal was mistaken.

Where we disagree that material is infringing, we will tell you why rather than simply declining. We would much rather resolve a disagreement in correspondence with you than through an intermediary.

Counter-notification

If your material was removed and you believe that was a mistake, or that you have the right to use the material, you may send a counter-notification to [email protected] including:

1. Identification of the material that was removed and the location at which it appeared.
2. A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification.
3. Your name, postal address, telephone number and email address.
4. A statement that you consent to the jurisdiction of the courts of your domicile, or, where you are outside the United States, of any judicial district in which we may be found.
5. Your physical or electronic signature.

Repeat infringers

We maintain a repeat infringer policy. Contributors, staff and partners who repeatedly submit material that infringes the rights of others will have their access to our publishing systems restricted, and in appropriate cases terminated. Accounts terminated under this policy are not reinstated.

Editorial standard for images

Illustrations published on our blog and glossary must be our own work, licensed stock, or a use that is clearly permitted and attributed. Publisher-owned game assets — including screenshots, promotional key art, logos and other marks — are not to be used for this purpose.

Trade marks and game references

Eloking provides coaching and player support services for a number of online games. Where we name a game or its publisher, we do so to identify the game our service relates to. All game titles, brands and registered trade marks referred to on this website remain the property of their respective owners. We are not affiliated with, endorsed by, or sponsored by any of those owners, and nothing on this website should be read as suggesting otherwise.
